The Form 23 is the single most important piece of paperwork a Victorian pool or spa owner needs. It's the legal record that your barrier — the fence, gates, latches and surrounding clear zone — meets the state's safety standard, and it's required both for initial pool registration and for every four-year renewal after that. Without a current Form 23, your pool is considered non-compliant in council's records, regardless of how solid or well-maintained your fence actually looks.
What the Form 23 certifies
A Form 23 confirms that, at the time of inspection, your barrier met every element of the required standard: minimum height of 1200mm, no gaps under or within the fence that would allow a small child through, a clear non-climbable zone around the outside of the barrier, and gates that reliably self-close and self-latch from any position. It doesn't cover anything about your pool's water quality, pump, filtration, or general maintenance — it's specifically and only about the physical barrier.
Who can issue a Form 23
Only an inspector registered with the Building and Plumbing Commission (BPC), formerly the Victorian Building Authority, in the specific category covering pool barrier compliance can issue a valid Form 23. Not every building surveyor or general inspector holds this registration, which is why it's worth confirming an inspector's credentials directly if you're arranging one independently rather than through a booking service that already vets this for you.

The 30-day lodgement requirement
Once your Form 23 is issued, you have 30 days to lodge it with your local council. This isn't paperwork you can leave sitting in a drawer — council relies on the lodged certificate to confirm your property's ongoing compliance status. Missing this window can trigger follow-up correspondence, and in some cases penalties, so we track this deadline for every booking and send a reminder well before it's due.
The four-year renewal cycle
A Form 23 is valid for four years from its issue date, after which a new inspection and a new certificate are required — indefinitely, for as long as the pool or spa exists. Yes, if your spa holds more than 300mm of water. It's assessed and certified the same way as a swimming pool barrier under Victorian requirements.
I'm selling my house — is my existing Form 23 enough?
If it's still within its four-year validity period and the barrier hasn't changed since it was issued, it can generally be used for the sale. If you've done any landscaping or renovation work near the pool since, a fresh inspection is the safer option.
